Under federal spending adjustments in the One Big Beautiful Bill Act passed last year, reductions in federal Medicaid contributions are prompting states to reassess non-mandated spending. While federal Medicaid rules mandate coverage for institutional care, state-level home- and community-based services remain largely discretionary under federal statute.

In Maryland, Democratic Gov. Wes Moore originally proposed a $150 million reduction to the state agency managing Medicaid programs for individuals with developmental disabilities. Lawmakers ultimately agreed on a $126 million budget reduction while removing a proposed annual cap on per-person funding.

Legal Clarifications and Resource Allocation

The U.S. Department of Justice issued an opinion memo clarifying that states are not federally mandated to fund home- or community-based care in cases where individuals do not face institutionalization. The DOJ also announced it would pause enforcement of previous administrative guidance associated with the 1999 Supreme Court ruling, Olmstead v. L.C., which addressed community placement alternatives.

Policy analysts supporting the federal updates argue that giving states regulatory leeway allows public funds to be directed toward individuals with the highest level of medical necessity. Rachel Barkley, director of the Able Americans policy project at the conservative National Center for Public Policy Research, noted that reform measures such as Medicaid work requirements “will free up more state funding for (home- and community-based services) recipients.”

Advocates for specialized facility care, such as the national organization VOR, have noted that rigid interpretations of federal integration mandates sometimes shifted individuals with complex behavioral or mental health conditions into community settings without sufficient local infrastructure, resulting in poor outcomes including homelessness.

Concerns Over Family Caregiver Strain

At the same time, disability rights advocates and affected families caution that reductions in localized support services could place heavy demands on relatives. Speaking to Stateline, advocate Jeneva Stone, whose son relies on home health care, expressed concern regarding the economic impact on households: “More and more burden falls on family caregivers to fill in the gaps, and that leads to unsustainable economic situations for families.”

As legal challenges proceed in states such as Texas and Florida, state leaders continue to balance fiscal responsibility, state flexibility, and the healthcare needs of disabled residents.
